Sayyid Usman, a Hadrami scholar in the 19th and early 20th century was very controversial. He was themufty of Batavia as well as advisor to the Netherlands East Indies. Especially as a mufty, Sayyid Usmanwas becoming a reference to the people who requested for a ruling of law. Supported by his ownprinting litographyc, Sayyid Usman was able to convey his views dan ideas widely through the publica-tion of books and treatises. The books produced by Sayyid Usman specialized in the field of Islamic lawor fiqh which refers to social jurisprudence. While related to the fiqh of worship, more concise and verysimple. Among his works in the field of law, the book of al-Qawanin al-Shar’iyyah is a very importantwork. This book contains a methodological description on how to take a legal decision (fatwa). Asadmitted, the purpose of writing al-Qawanin is a guide for prince and a judge of religion, especially inlegal decisions based on Ahlu Sunna sect.

Recently, the term of jihad has been used by certain people for improper purposes. At the time of theProphet and the classical Islamic period, jihad meant as an effort to uphold and fight for Islam with awealth, soul, body, mind, and  deeds. Nowdays certain people have been understanding and applyingthis term in the form of terror. They understand it solely as ‘the holy war’ against the unbelievers withparadise as a reward for martyrs who died for it. In the name of jihad, in this decade there are manybombings in Indonesia and other hemisphere. Bomb terrors not only occur in non-Muslim countriesbut also in Muslim countries which also cause Muslim victims. The question then is what are theiractions really the jihad as it is thought by Islam? To answer this question, this paper tries to explain theconcept of jihad in the perspective of two scholars who live in contemporary era, namely Sayyid Sabiqand Abu Bakr Jabir al-Jazayri by examining definition of jihad concept, legal basis and implementationof jihad, categories of jihad, and orientation of jihad understanding in the context of modern life.Through this study it is expected that the solution of jihad formulation  in the context of modern lifecan be  clarified and resolved.

The main problem of this paper is how political policy direction of local government and communityresponse to the institutionalization of norms of Islamic law in Indonesia’s local regulations. This paperuses the theoretical framework of thought which devides three Islamic groups, namely ideologicalIslamic group, moral-ethical Islamic group, and the middle way of Islam. In this paper, the direction ofgovernment policy was oriented towards the third Islamic group’s concept which institutionalizes theShari’a as a rule of formal government, but most of the only aspects of private law only, while theresponse of the majority of the community is oriented in a second Islamic group which requires theinstitutionalization of religious ethical values  which the terms of Shari’ah institutionalized in thenational legal system. Therefore, the results of surveys and responses among Indonesian thinkers moreinquire the existence of the institutionalization of norms of Islamic law than accept it. However, if anyshould be institutionalized, they would prefer the public aspects of Shari’a which should be institution-alized and implemented.

This study deals with how American Muslim women gave meanings to hijab. The data used consistedof the verbal expressions of the subject of the study. The data source included the documents of newsand talks conducted by the National Public Radio (NPR) headquartered at Washington D.C. The data-collecting method was library research. The study concluded that the various views on hijab amongAmerican Muslim were more than the diversity of interpretations of the scriptures. They representedthe encountering dynamics of Islam and American culture. At the economic domain, American cultureaccommodated the hijab as it may represent certain values that helped sell American products. At thesocial, political, and religious domains, however, Americans had a greater prejudice and resistance as theyassociated hijab with fundamentalism, fanaticism, extremism, and even terrorism.

In study of Islamic law there is an interesting topic to discuss, that is maqasid al-shari‘ah. Recently someMuslim scholars study further the applying of principle of daruriyat al-khamsah in a legal problem.Unfortunately Islamic jurists often apply the principle of daruriyat al-khamsah independently apart fromother sciences besides usul al-fiqh. Difficulties and failure in deciding many contemporary legal problemsrise to the result. Jasser Audah, a Muslim scholar from Egypt and lives in London proposes new ideato cope with this problem. According to Audah, at first we must separate maqasid al-shari‘ah from usul al-fiqh in order to be independent knowledge. Then we combine it with modern sciences in studying legalproblem. Only through this method, Auda believes that Islamic law will be more adaptable with thechanging situation. In order to do his idea in developing maqasid al-shari‘ah, Auda specifically suggestsfive steps, that are: validating all cognitios, holism, openness and self-renewal, multi-dimensionality,and purposefulness.

Pendahuluan

Dan orang-orang yang mengerahkan segenap daya upaya untuk (mencari keridhaan)Kami, benar-benar akan Kami tunjukkan kepada mereka jalan-jalan Kami (QS. 29:69).Apabila kalian berlainan pendapat tentang sesuatu, maka kembalikanlah ia pada Allahdan Rasul (QS. 4:49).

 

Berdasar pada dua ayat inilah fuqaha mengkaji al-Qur’an dan Sunnah untuk menemukan hukum-hukum yang terkandung didalamnya. Berawal dari dua ayat tersebut pula, sebagian ulama berpendapat bahwa al-Qur’an dan Sunnah sudah cukup untuk menjadi sumber pengambilan hukum, menolak qiyas dan akal dalam proses pengambilan hukum. Di antaranya ada yang hanya memperbolehkan qiyas dan melarang sama sekali penggunaan akal (Muslehuddin dalam Sirry, 1995: 165). Perbedaan ini melahirkan dua aliran besar dalam fikih, tekstual dan kontekstual.

Wakaf is one of the main religious service which contains productive economic values but in reality thevalues haven’t fully been implemented. The most important factor of this is the lack of socializationand the minimum role of the government (Badan Wakaf Indonesia). The enactment of the new wakafbill (UU No. 41/2004) which followed by Peraturan Pemerintah Nomor 42 Tahun 2006 has not effectiveyet. How to maximize waqf advantages for society empowerment? This is the focus of study. The resultof study shows that wakaf is very important to be the source of capital for empowering umat’seconomy. The way to understand (fiqh}) wakaf must be reformulated. The maximization of produc-tive wakaf needs proper public understanding and good management. That is why that the nadhirmust fulfill moral, managerial, and entrepreneur qualifications. The writer conclude that only troughrevitalizing the role of BWI and the public awareness, the new paradigm of waqf can be realized inIndonesia.

A major source of revenue for an Islamic state since the days of Umar ibn Khatab and until the decay ofthe Islamic civilization was kharaj and ‘ushr. In this paper a fiscal analysis of this levy will be presentedhighlighting what kharaj and ‘ushr understood by Khalifah Umar and early fuqaha. An Islamic govern-ment is not free to handle public money the way it likes. Public money should be spent judiciously toachieve desired goals. It is a duty of the government in a Muslim state not to squander public moneybut to utilize it to improve living standard of people. Technically, this duty needs to be explaining indetail by fuqaha. Encountered of the Islamic public finance thinking as scattered in Islamic literatureindicate that there is no such “missing link” in the construction of economic science as proposed by thethesis of the great gap, especially in the thoughts of public finance.

In pluralistic society, democracy has become the best solution for respecting human rights dan giving thefreedom of expression. Normatively, democracy could solve any social-political issues through majorityvoices. Even though, Islam has not mention the term of democracy, its basic tenets teaches thathumankind is equal before God; and it teaches that the nobility of humankind depends on  theirproximity and nearness to God. Islam explicitly forbids the believe in that one nation to claim theirsuperiority than the others. In Islam, syura has the significant role of solving any kinds of problem inliving together.  Thus, democracy in principle did not transgress the Islamic teaching on humanism. Onthe contrary, sectarianism has created negative sentiment and conflict between East and West whichapparently represented by United States and Middle East. Through their sophisticated camouflage theUnited States has accused almost Islamic countries   as the hotspot of terrorism, even thought theirindictment has been factually wrong and misguided.

Environmental crisis has been recognized as a global phenomenon and has come at a level that veryendangers human life on earth. Environmental crisis is not a matter of a nation, race, religion, or group.It has been a common problem and requires global cooperation to overcome barriers regardless ofreligion and race. Within this framework, every religion and traditions required to contribute in jointactions to overcome the environmental crisis. This is so, because the efforts of political and secular laware considered no longer sufficient to resolve the tragedies of today’s ecological problem on earth.Therefore, this paper will explore the perspective of Environmental Fikih in the context of a globalmovement in overcome the environmental crisis.

Trade contracts via the internet (cyberspace transactions) or e-commerce or in other terms is a necessity inthe development of cyberspace in the last  ten decades. In terms of the applicable legal aspects, contractstrade via the internet is having a substantial difference with the conventional contract law. From theviewpoint of Islamic Law (fiqh), the implementation of e-commerce business transactions can besamed with al-sala>m transactions in the way of payment and delivery of commodities which serve as theobject of the transaction. Transactions in e-commerce over the Internet can be aligned with the principlesof the existing transaction in the transaction al-salam, especially relating to the parties involved in thetransaction, the consensus statement and transaction through a transaction object. Based on thesestudies, the commercial transactions over the Internet is allowed as long as meet the principles of thecontract (‘aqad) in Islam, namely: (1) the parties involved in implementing the contract with proves goodand sincerity; (2) the process of conveying statements of the consensus between party is clear and notconflicting with shar’i; and (3) the object of transactions (goods or services) is something that is halal.
